Description
Per Curiam Appellant was convicted of voluntary manslaughter and punishment was assessed at twenty years' confinement. In his first ground of error, appellant argues that the trial court erred in submitting a charge of voluntary manslaughter to the jury when the evidence did not raise the issue of voluntary manslaughter. The indictment in the case alleged that appellant caused the death of the victim by stabbing him with a knife. In its charge to the jury, the court charged the jury on the primary offense of murder and, over the appellant's objection, on the lesser included offense of voluntary manslaughter. The jury found appellant guilty of the lesser included offense.
